GFR 2017 Rule 170(i)
Micro & Small Enterprises (MSEs) registered with Udyam or District Industries Centre are 100% exempt from paying Bid Security (EMD).
Public Procurement Policy 2012 Sec 11
All Central Ministries, Departments, and CPSUs must provide free tender documents and EMD waiver to qualifying MSEs.
What happens if a procuring entity rejects my EMD exemption claim?
Under DoE OM No. F.9/4/2020-PPD, rejecting a valid MSE EMD exemption is a violation of central procurement rules. You can immediately file a pre-bid representation citing GFR Rule 170(i) and attach your Udyam Certificate showing the relevant manufacturing or service NIC code.
Can Medium Enterprises claim EMD Exemption?
No. GFR Rule 170 and the Public Procurement Policy 2012 strictly restrict EMD waivers to Micro and Small Enterprises. Medium Enterprises must submit the required cash deposit or Bank Guarantee unless exempted by specific state industrial policies.
When is EMD refunded to unsuccessful bidders?
Under GFR Rule 170(ii), Bid Security must be refunded to unsuccessful bidders at the earliest after the expiry of the final bid validity period and latest on or before the 30th day after the award of the contract.
